Two constitutional judges made a very interesting argument on democracy and freedom, which not only applies to defend but also to violates civil rights at the same time, and an analogy which brings some birds.
So interesting that it made me take some time to translate a court ruling for the first time. You probably don’t know what democracy is until you read this—at least in a South Korean sense:
“It is dangerous to understand what the defendant, or the leading faction [of the UPP] and North Korea claim via their own words without the capability to see through their various tactics, which could make herself walk into their trap. One should be alert not to become what Lenin called useful idiots, who mistake their masks for truth including ignorant mobs in the square, opportunistic intellectuals and journalists, pseudo-progressives, and populist politicians. Impossible it is to protect those who have no will to defend themselves. Nation is no exception. […]
“Democracy not only endorses freedom of opinion, criticism, idea, and culture but it is also obliged to do so. This is the paramount virtue and value of democracy which is developed by we the mankind. However, we should act decisively against those who are in denial of democracy itself and trying to tear down its foundation. It couldn’t be allowed indefinitely in the name of tolerance to demolishing the very existence of democracy, from which the security, the freedom, and the happiness of us and our progeny derive. Cuckoo secretly lays eggs in a tit’s nest and the ignorant tit broods them devotedly. A baby cuckoo takes over the nest after shoving the tit’s eggs and babies off. […] One who detects them and takes measures preserves its kind but one who let them as they are, ironically, perishes.” ((Italics mine to emphasize those were originally written with quotation marks as emphases since the Korean way of punctuation doesn’t have italics.))

민주주의는 자유로운 의견과 비판, 모든 사상과 문화를 허용하고 보장하며, 또 반드시 그렇게 해야 한다. 이것이야말로 우리 인류가 발전시켜온 민주주의의 최고의 장점이고 가치이기도 하다. 그러나 민주주의 자체를 부정하고 그 근본을 무너뜨리려는 행위에 대해서는 단호히 대처해야 한다. ‘우리들과 우리들의 자손의 안전과 자유와 행복’의 바탕인 자유민주주의의 존립 그 자체를 붕괴시키는 행위를 관용이라는 이름으로 무한정 허용할 수는 없는 것이다. 뻐꾸기는 뱁새의 등지에 몰래 알을 낳고, 이를 모르는 뱁새는 정성껏 알을 품어 부화시킨다. 그러나 알에서 깨어난 뻐꾸기 새끼는 뱁새의 알과 새끼를 모두 둥지 밖으로 밀어낸 뒤 둥지를 독차지하고 만다. […] 뻐꾸기 알을 발견하고 적절한 조치를 한 뱁새는 자신의 종족을 보존하게 되지만, 그대로 둔 뱁새는 역설적으로 자기 새끼를 모두 잃는다.
